These Terms of Use (hereinafter referred to as the “GTU”) govern the conditions for the online reservation of a vehicle from the Lessor by the Customer. We kindly ask you to read these GTU before confirming your reservation. You will be asked to confirm that you have read and understood them as an integral part of the General Rental Conditions (hereinafter referred to as the “GRC”) before finalizing your reservation.
The main steps to follow in order to make an online car reservation are as follows:
Enter your rental criteria on the online reservation form, including: the type of vehicle, the rental period, the vehicle pick-up and return times, as well as the rental agency of your choice.
Based on the criteria you provide, we will offer several options corresponding to your request.
An offer is defined as a service including a vehicle category available for the selected duration, with the requested options and a price that may be either a “prepaid” rate or a “pay at agency” rate.
You may then select the offer that best meets your expectations.
You may then select optional equipment (child seat, booster seat, etc.) or additional protection products by clicking on the corresponding icons. The cost of each selected option and/or additional protection product will then be added to the final price of your rental.
Once you have completed your reservation, you will be asked to click on the “Book” tab in order to temporarily reserve the selected offer.
After completing all your personal details, you will be asked to review your reservation summary and give your consent. To do so, you will be invited to read the General Rental Conditions and the explanatory document relating to applicable insurance and additional protection products. Once these Conditions have been accepted, you may then finalize your reservation either by prepaying after clicking on the “Pay online” tab or by confirming your reservation by clicking on the “Pay at Agency” tab.
If you choose the “Pay online” option: you must pay the full rental amount directly online under the conditions detailed in Article 4 hereof.
If you choose the “Pay at Agency” option: you will then be required to pay part of the rental amount directly on the website as a deposit in order to reserve the vehicle and to pay the balance of the rental amount at the agency on the day the vehicle is collected. In the event of cancellation of the reservation, the deposit collected by the Lessor will not be refunded.
Once your reservation has been made, the Lessor will send you a reservation confirmation by email including your reservation number and all the details of the reservation, together with an attached copy of the GRC and the explanatory document relating to applicable insurance and additional protection products. We recommend that you print these documents and keep them for your records.
We accept reservations up to 60 minutes before the vehicle pick-up time.
You may make your reservation up to 24 months in advance.
The minimum rental period is 1 day (except under the “Hourly Rental” offer). 1 day corresponds to 24 hours. These 24 hours include the time required for vehicle pick-up and return at the agency. Rentals of less than 24 hours are charged at the price of a full day, except in certain agencies where hourly rentals apply. Certain vouchers or promotions require a longer mandatory minimum period. Please refer to the general terms and conditions of the offer or voucher concerned.
You may rent your vehicle for a maximum period of 12 months.
Your car rental quote includes all charges corresponding to your reservation criteria.
This quote generally includes the following items:
Any applicable local taxes;
Unlimited mileage, or, if this is not the case, the number of kilometers included will be indicated in the package, together with the cost per additional kilometer;
The Registration Fee Contribution;
Third-party Liability;
Vehicle damage protection (“CDW” Collision Damage Waiver) and theft protection (“TW” Theft Waiver), limiting your liability ceiling to the amount of the non-waivable excess. This amount may be reduced by taking out additional protection at the time of rental allowing an excess waiver. The list of these charges is indicated on the reservation confirmation.
Personal Accident Insurance for the driver (“PAI” Personal Accident Insurance). This insurance covers bodily injury and death of the driver of the rented vehicle, as well as emergency medical expenses.
The rates are guaranteed for the rental associated with the confirmed reservation and summarized in the reservation email.
Additional charges may be included in your basic rental:
Additional Driver: whenever there is more than one driver for a rental, the second driver and/or any other drivers are additional drivers. An additional surcharge may apply for each additional driver.
The Young Driver surcharge.
The surcharge for optional equipment selected at the time of reservation.
The “Vehicle pick-up outside opening hours” surcharge.
“Online payment” (prepaid rate at the time of reservation)
All credit card payments are authorized at the time of reservation in the case of a prepaid rate.
Warning: the payer (i.e. the credit card holder) for the prepaid reservation must be the main driver named on the rental agreement and must present a credit card in his or her first and last name when collecting the vehicle.
Payment may be made using the following payment methods:
Payment cards bearing the wording “CREDIT”: the amount will be debited from you in whole or in part on the previously agreed day of a given calendar month, with or without interest (deferred debit).
Payment cards bearing the wording “DEBIT”: your account balance will be debited after each transaction (immediate debit).
“Payment at agency”
Payment cards in the cardholder’s name bearing the wording “CREDIT”: the amount will be debited from you in whole or in part on the previously agreed day of a given calendar month, with or without interest (deferred debit).
Payments by cheque or cash are not authorized.
“Payment abroad”
The rules applicable to accepted payment methods vary depending on the country of rental.
If you reside abroad, we strongly recommend that you come to the Lessor’s Agency with a bank card allowing a pre-authorization. We advise you to contact the Lessor’s Agency for further details on the accepted payment methods.
For information on the age limit, driving licence and documents required for a rental, please refer directly to the applicable General Rental Conditions of the Lessor.
For any reservation modification, please contact the Lessor at least 48 hours before the vehicle pick-up time.
You acknowledge that new rental prices may apply if you modify your reservation.
If you have prepaid your reservation online, please contact the Lessor in order to cancel the reservation. The General Rental Conditions will apply to govern the cancellation of your reservation.
If you have not prepaid your reservation online, please contact the Lessor in order to cancel the reservation. The deposit paid when reserving the vehicle will not be refunded by the Lessor.
The vehicle pick-up agency is required to provide a vehicle in the category specified in the reservation under the following conditions. If this is not possible, a solution will be proposed at no additional cost within one hour of your arrival.
If, at the time of reservation, you did not provide your payment card details, the Lessor undertakes to hold your reservation until one hour after the time specified in the reservation.
The Lessor will make every effort to provide the vehicle category after the tolerance period and until its closing time. If this is not possible, an alternative will be proposed, which may result in a new rate.
If, at the time of reservation, you specified your payment card details, the Lessor undertakes to provide you with your vehicle category until its closing time.
Beyond this limit, if you have not appeared, no-show fees (“No show”) will be applied (see Article 7.4).
At airports, the reservation is guaranteed until 1 hour after the arrival time specified in the reservation indicating the flight number.
In the event of a flight delay, we serve customers until 1 hour after the actual arrival time. If we were required to go beyond our normal opening hours, we would then be entitled to apply an additional charge.
If you have not cancelled your reservation and do not appear at the agency to collect the vehicle (on the start date and time stated in your reservation confirmation email), the Lessor reserves the right to retain the rental amount collected as compensation.
If we were unable to guarantee the provision of a vehicle in the reserved category, we would offer you:
a free upgrade; or
a downgrade and a refund of the difference in amount;
In cases where these two alternatives would not be acceptable and no vehicle in the reserved category would be available during the hour following the scheduled departure time, we would offer you the following alternative at no additional cost:
the organization of transport to the nearest Lessor agency within a limit of 50 km; OR
the rental of a vehicle from another company located near the Lessor’s agency.
Neither party shall be liable for its performance in cases of force majeure, as defined by the regulatory authorities, which prevent the party from fulfilling its obligations.
Accordingly, in the following cases:
Reservation with prepayment: the transaction will be cancelled and the agency will refund the amount received. The agency will not be bound by any obligation beyond the refund;
Reservation guaranteed beyond one hour: the reservation will expire, no fees will be charged and the agency will be released from its obligations.
In the event of a dispute, the Customer shall first contact the Lessor’s Customer Service Department in order to resolve it amicably. If this approach fails, the Customer may use the CMAP online mediation service (Centre de médiation et d’arbitrage de Paris), accessible at the URL: http://www.cmap.fr/ or at the postal address: CMAP (Consumer Mediation Service) - 39 avenue Franklin D. Roosevelt - 75008 Paris, or by email at consommation@cmap.fr and by telephone on 01 44 95 11 40.
In order for the referral to the CMAP to be admissible, it must include: your postal address, email address and telephone details, as well as the full name and address of our company, a brief statement of the facts and proof of the preliminary steps taken.
In accordance with the rules applicable to mediation, it is recalled that a consumer dispute must first be submitted in writing to the Lessor’s Customer Service Department before any request for mediation is made to the CMAP.
These GTU are governed by French law and are accessible on the Lessor’s website, hosted in France. French law is therefore fully applicable.
Any dispute arising from your reservation may be submitted to the court of your permanent place of residence or of your place of residence at the time of conclusion of the contract or of the harmful event.
